Terms of Service

1. Service Description

CultureMatch ("the Service") is a SaaS platform that helps companies assess and match organizational culture with job candidates through AI-powered questionnaires and evaluations. The Service is operated by CultureMatch, based in Amsterdam, the Netherlands.

2. Account Terms

  • You must provide accurate and complete registration information.
  • You are responsible for maintaining the security of your account and password.
  • You are responsible for all activity that occurs under your account.
  • You must be at least 18 years old to use the Service.
  • One person or legal entity may not maintain more than one free account.

3. Subscriptions and Billing

  • Paid plans are billed in advance on a monthly or annual basis.
  • All fees are in Euros (EUR) and are non-refundable except as required by law.
  • You may upgrade or downgrade your plan at any time. Changes take effect at the next billing cycle.
  • Cancellation takes effect at the end of the current billing period. You retain access until then.
  • We reserve the right to change pricing with 30 days' notice.
  • Payment processing is handled by Mollie. By using the Service, you agree to Mollie's terms of service.

4. Fair Use and Limits

  • Each plan includes specific usage limits (AI evaluations, users, job postings).
  • Exceeding plan limits may result in temporary feature restrictions until the next billing period or purchase of add-ons.
  • Automated or programmatic access beyond normal API usage requires prior approval.

5. Data Ownership

  • Your Data: You retain full ownership of all data you input into the Service, including questionnaire responses, employee data, and candidate information.
  • Our Service: CultureMatch retains ownership of the Service, its algorithms, AI models, scoring methodologies, and interface designs.
  • AI-Generated Content: Content generated by our AI (job descriptions, evaluations, handbook chapters) is provided for your use under your subscription. You may use this content freely in your business operations.
  • Data Export: You may request an export of your data at any time by contacting us.

6. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose or in violation of anti-discrimination laws.
  • Attempt to reverse-engineer, decompile, or extract source code from the Service.
  • Use the Service to build a competing product.
  • Share your account credentials or allow unauthorized access.
  • Submit false, misleading, or harmful content.
  • Attempt to circumvent usage limits or billing mechanisms.

7. AI and Automated Decisions

The Service uses AI to generate culture match scores and candidate evaluations. These scores are recommendations only and should not be the sole basis for hiring decisions. You are responsible for ensuring your hiring practices comply with applicable employment and anti-discrimination laws.

8. Service Availability

  • We aim for 99.9% uptime but do not guarantee uninterrupted access.
  • We may perform scheduled maintenance with reasonable advance notice.
  • We reserve the right to modify or discontinue features with 30 days' notice.

9. Limitation of Liability

To the maximum extent permitted by law, CultureMatch shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly. Our total liability shall not exceed the amount you paid for the Service in the 12 months preceding the claim.

10. Termination

  • You may cancel your account at any time through the Service or by contacting us.
  • We may suspend or terminate accounts that violate these terms, with notice where practicable.
  • Upon termination, your data will be retained for 30 days to allow export, then permanently deleted.

11. Governing Law

These terms are governed by the laws of the Netherlands. Any disputes shall be resolved in the courts of Amsterdam, the Netherlands.

12. Changes to Terms

We may update these terms from time to time. We will notify you of material changes via email or in-app notification at least 30 days before they take effect. Continued use of the Service after changes take effect constitutes acceptance.
