1. Service description
CultureMatch ("the Service") is a SaaS platform that helps companies assess organisational culture and match it with job applicants through AI-driven questionnaires and evaluations. The Service is operated by DeDarkRoos B.V. under the name CultureMatch, based in Almere, the Netherlands.
2. Account terms
- You must provide accurate and complete registration information.
- You are responsible for maintaining the security of your account and password.
- You are responsible for all activity that occurs under your account.
- You must be at least 18 years old to use the Service.
- One person or legal entity may not maintain more than one free account.
3. Subscriptions and billing
- Starter and Growth subscriptions are billed in advance on a monthly or annual basis.
- All fees are in euros (EUR), exclude 21% VAT and are non-refundable, except where required by law.
- You may upgrade or downgrade your subscription at any time. Upgrades take effect immediately: the new plan starts that day with a new billing date and the full credits of the new plan, and your first payment is the price of the new plan minus the unused part of your current paid period. From a yearly plan you can upgrade to the higher yearly plan. Downgrades take effect at the end of the paid period; nothing is refunded.
- Cancellation takes effect at the end of the current billing period. You retain access until then, after which your company moves to the Free plan and your account and data are kept.
- We reserve the right to change prices with 30 days' notice.
- Payment processing is handled by Mollie. By using the Service, you agree to Mollie's terms of service.
- Each company has one 14-day trial of Starter or Growth. It starts with a €0.01 check via iDEAL or card, which is not refunded. At the end of the 14 days the trial converts into the paid plan, which is then charged, unless you cancel before it ends. A company that has already had a trial is charged straight away.
- If a payment is refused or charged back, your company moves to the Free plan. Your account and data are kept.
- Founding 30 usage is not billed in advance: it is billed monthly in arrears, at cost price plus 21% VAT, on a credit card. Amounts under €1 roll over into the next month.
4. Fair use and limits
- Each subscription includes specific usage limits (credits, admin and viewer seats).
- Exceeding subscription limits may result in temporary feature restrictions until the next billing period or the purchase of extra credits.
- Automated or programmatic access beyond normal API usage requires prior approval.
5. Data ownership
- Your data: You retain full ownership of all data you enter into the Service, including questionnaire responses, employee data and candidate information.
- Our Service: CultureMatch retains ownership of the Service, its algorithms, AI models, scoring methodologies and interface designs.
- AI-generated content: Content generated by our AI (job descriptions, evaluations, handbook chapters) is made available to you for use under your subscription. You may use this content freely in your business operations.
- Data export: You may request an export of your data at any time by contacting us.
6. Acceptable use
You agree not to:
- Use the Service for unlawful purposes or in violation of anti-discrimination laws.
- Attempt to reverse-engineer, decompile or extract the source code of the Service.
- Use the Service to develop a competing product.
- Share your account credentials or allow unauthorised access.
- Submit false, misleading or harmful content.
- Attempt to circumvent usage limits or billing mechanisms.
7. AI and automated decisions
The Service uses AI to generate culture match scores and candidate evaluations. These scores are recommendations only and must not be the sole basis for hiring decisions. You are responsible for ensuring your hiring practices comply with applicable employment and anti-discrimination laws.
8. Service availability
- We aim for 99.9% availability but do not guarantee uninterrupted access.
- We may perform scheduled maintenance with reasonable advance notice.
- We reserve the right to modify or discontinue features with 30 days' notice.
9. Limitation of liability
To the maximum extent permitted by law, CultureMatch shall not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits or revenue, whether incurred directly or indirectly. Our total liability shall not exceed the amount you paid for the Service in the 12 months preceding the claim.
10. Termination
- You can delete your account at any time through the Service or by contacting us.
- We may suspend or terminate accounts that violate these terms, with notice where reasonably possible.
- When your account is deleted or the agreement is terminated, we keep your data for 30 days and then delete it permanently.
11. Governing law
These terms are governed by Dutch law. Any disputes will be submitted to the competent court in Amsterdam, the Netherlands.
12. Changes to these terms
We may update these terms from time to time. We will notify you of material changes at least 30 days before they take effect, by email or an in-app notification. Continued use of the Service after the changes take effect constitutes acceptance.
